Welcome to Parleva! These Terms of Service ("Terms") govern your access to and use of the Parleva application, website, and services (collectively, the "Service"). Please read these Terms carefully before using the Service.
By using Parleva, you agree to these Terms. If you do not agree, please do not use the Service.
1. Acceptance of Terms
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
Parleva is an AI-powered language learning platform that provides:
Conversational practice with an AI language coach
Adaptive difficulty based on your proficiency
Speech recognition and text-to-speech features
Progress tracking and learning statistics
The Service uses artificial intelligence to generate responses. While we strive for accuracy, AI-generated content may contain errors and should not be relied upon as the sole source of language instruction.
3. Eligibility
You must be at least 13 years old (or 16 in the European Economic Area) to use the Service. By using Parleva, you represent that you meet this age requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.
4. Account Registration
4.1 Account Creation
To access certain features, you must create an account. You agree to:

Maintain and update your information as needed
Keep your password secure and confidential
Notify us immediately of any unauthorized access
4.2 Account Responsibility
You are responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from unauthorized use of your account.
5. Free Trial and Subscription
Simple, transparent pricing with no hidden fees or surprise charges.
5.1 Free Trial
New users receive a limited free trial (currently 10 conversation turns)
Trial limits may change at our discretion
Trial usage is tracked per user and cannot be reset
5.2 Paid Subscription
After the free trial, continued access requires a paid subscription
Subscription fees are billed in advance on a recurring basis (monthly or annually)
Prices are listed on our website and may change with 30 days' notice
Payment is processed securely through Stripe
5.3 Free Trial Period for Subscriptions
New subscriptions may include a free trial period. You will not be charged during the trial. If you do not cancel before the trial ends, your subscription will automatically begin, and you will be charged.
5.4 Cancellation
You may cancel your subscription at any time through your account settings
Cancellation takes effect at the end of the current billing period
You will retain access until the end of your paid period
No refunds are provided for partial billing periods
5.5 Refunds
Refunds may be granted at our discretion in the following circumstances:
Technical issues that prevented use of the Service
Accidental duplicate charges
Within 7 days of initial subscription if substantially unused

6. Acceptable Use
Use Parleva for what it's designed for: language learning.
You agree NOT to use the Service to:
Violate any applicable laws or regulations
Infringe on intellectual property rights of others
Transmit harmful, offensive, or inappropriate content
Attempt to manipulate or abuse the AI system
Circumvent usage limits, security measures, or access controls
Use automated systems (bots, scrapers) to access the Service
Interfere with or disrupt the Service or servers
Impersonate others or misrepresent your identity
Collect or harvest user data without consent
Use the Service for commercial purposes without authorization
7. Content and Intellectual Property
7.1 Our Content
The Service, including its design, features, code, AI models, and learning content, is owned by Parleva and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.
7.2 Your Content
You retain ownership of the messages and content you create through the Service. By using the Service, you grant us a limited license to:
Process your content to provide the Service
Store your content for your access and our service delivery
Use anonymized, aggregated data to improve the Service
7.3 AI-Generated Content
Responses generated by our AI are provided for educational purposes. You may use AI-generated responses for personal learning. However:
AI responses may contain errors or inaccuracies
You should verify important information from authoritative sources
We do not guarantee the accuracy of translations or language advice
8. Third-Party Services
The Service integrates with third-party providers:
OpenAI: For AI conversation processing
Firebase/Google: For authentication and data storage
Stripe: For payment processing
Browser Speech APIs: For voice recognition
Your use of these third-party services is subject to their respective terms and privacy policies.

Parleva is a supplementary learning tool, not a replacement for formal education.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We disclaim all warranties, including but not limited to:
Merchantability and fitness for a particular purpose
Accuracy, reliability, or completeness of content
Uninterrupted or error-free operation
Security of data transmission
Parleva is a supplementary learning tool and is not a substitute for formal language education, professional translation, or certified language assessment.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
We are not liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
We are not liable for any loss of data, profits, or business opportunities
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Parleva, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

12. Termination
You can leave anytime. We may end access if Terms are violated.
12.1 By You
You may stop using the Service and delete your account at any time through your account settings or by contacting us.

We may suspend or terminate your access if:

Required by law
We discontinue the Service (with reasonable notice)
12.3 Effect of Termination
Upon termination:
Your right to use the Service ends immediately
We may delete your data after a reasonable retention period

13. Dispute Resolution
13.1 Informal Resolution

13.2 Governing Law
These Terms are governed by the laws of Indiana, without regard to conflict of law principles.
13.3 Arbitration Agreement
Any disputes that cannot be resolved informally will be resolved through binding arbitration, except for claims that qualify for small claims court. You agree to waive the right to a jury trial and to participate in class actions.
13.4 Exceptions
This arbitration agreement does not apply to:
